Little Falls Swim and Dive

By checking this box, I certify that I am an equity member in good standing of the Little Falls Swimming Club, or have accepted and paid for full season or end-of-season rivileges.  

RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, AND PARENTAL CONSENT AGREEMENT

In consideration of being permitted to participate in any way, in any Montgomery County Swim or Diving League activity, I, for

myself, my personal representatives, assigns, heirs, and next of kin:

1) Acknowledge, agree, and represent that I understand the nature of the activity and that I am qualified, in good

health, and in proper physical condition to participate in such activity. I further agree and warrant that if I at any time

believe conditions to be unsafe, I will immediately discontinue further participation in the activity.

2) Fully understand that: a) Athletic activities involve risk and dangers of serious bodily injury, including permanent

disability, paralysis, and death (“RISK”); b) These risks and dangers may be caused by my own actions or

inactions, the actions and inactions of others participating in the activity, the condition in which the activity takes

place, or the negligence of the “releasees” named below; c) There may be other risks and social and economic

losses either not known to me or not readily foreseeable at this time; I fully accept and assume all such risks and all

responsibility for any and all losses, costs, and damages I incur as a result of my participation or that of the minor in

the activity.

3) Hereby release, discharge, and covenant not to sue the Montgomery County Swim or Diving League ("MCSL" or “MCDL”), any related affiliated subsidiary of the MCSL or MCDL, as well as the officers, directors, agents, employees and assigns of the MCSL, MCDL, and any related affiliated subsidiary of the MCSL or MCDL, and the MCSL and the MCDL’s associations, clubs, coaches, officials, administrators, members, volunteers, participants, sponsors, advertisers, judges, referees and, if applicable, owners, and lessors of the premises on which the activity takes place, and any party indemnifies and held harmless by the MCSL and MCDL, (each considered one of the “releasees” herein), from all liability, claims, demands, losses , or damages on my account caused or alleged to be caused in whole or in party by the negligence of the “releasees” or otherwise, including negligent rescue operations, negligent security, travel and recreational operations and activities; and further agree that in addition to this release and waiver or liability, assumption of risk and indemnify, save and hold harmless each of the releasees from any litigation expenses, attorney fees, losses, liabilities, damages, or costs which may be incurred in anyway as the result of any and all such claims(s).

I have read this agreement, fully understand its terms and understand that I have given up substantial rights by

signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a

complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion

of this agreement is held to be invalid, the balance, notwithstanding, shall continue to be in full force and effect.

And I (we), the minor’s parent(s) and/or legal guardian(s), have read the above “Release, Waiver of Liability,

Assumption of Risk, indemnity, and Parental Consent Agreement”, and acknowledge and agree, and represent that

I (we) understand it and agree to it and incorporate it herein, and also acknowledge, agree and represent that I (we)

understand the nature of the athletic activities and the minor’s experience and capabilities and believe the minor to

be qualified, in good health, and in proper physical condition to participate in such activities. I (we) hereby release,

discharge, and covenant not to sue and agree to indemnify and save and hold harmless each of the releasees from

all liability, claims, demands, losses, or damages on the minor’s account, and on my of our account, caused or

alleged to be caused in whole or in party by the negligence of the “releasees” or otherwise, including negligent

rescue operations and further agree that if, despite this release, I (we), the minor, or anyone on the minor’s behalf,

or anyone on my or our behalf, make(s) a claim or claims against any of the releasees named above, I (we) will

indemnify, save and hold harmless each of the releasees from any litigation expenses, attorney fees, losses,

liabilities, damages, or costs anyone may incur as the result of any such claim or claims.

I understand that regardless of when I register during the season, fees will not be prorated.  I also understand that if I register for a swim program for which my child has not been approved and a switch must be made as a result, I will incur a processing fee.

We are so pleased that we are allowed to invite End-of-Season Guests to participate in all swim and dive team activities (with the exception of A swim meets).  Little Falls Swimming Club is required by Montgomery County to take certain steps to limit the noise impact that the pool has on the surrounding neighbors, because the pool is so close to the houses of the surrounding neighbors.  To ensure that we are complying with our obligations, please confirm your understanding of the following rules about pool privileges for End-of-Season Guests:  (1) I understand that team members who are EOS guests must check-in at the front desk before each team activity; (2) I understand that team members are not permitted use of the pool or tennis courts (unless as the guest of another LFSC member) before or after the team activities; (3) I understand that use of the pool prior to August 1 is limited to the swim/dive program participation for the registered participants and not other family members (realizing of course that young children will require supervision of a parent or guardian); and (4) I understand that that EOS Guests are not permitted to purchase Daily Guest Passes.  Please confirm that you understand that abuse of these EOS privileges as a swim/dive program participant may negatively impact future membership opportunities.  Thank you for understanding.
